Research Case: Why were ten legion commanders elected when Verginius raised the standard of revolt?

A Three-Layer Analysis (TLA) of Livy, History of Rome, Book 3

1. Question

Why were ten legion commanders elected when Verginius raised the standard of revolt?

This question examines why the rebellion after the Verginia incident did not end as a simple riot or revenge, but was connected to the redesign of the Roman republican OS.

The Verginia incident destroyed the legitimacy of the Decemvirate.

There was no appeal.

There were no tribunes.

Justice followed Appius’ private desire.

The crowd destroyed the fasces and withdrew approval from public office authority.

Verginius appealed to the soldiers, and a private incident turned into military secession.

The army and the plebeians seceded to the Sacred Mount, and the execution environment stopped participating in the governing OS.

However, the important point is that the army and the plebeians did not simply dissolve.

After they stopped obeying the Decemvirate, the army also needed its own circuits of command, representation, negotiation, and order maintenance.

For that purpose, ten legion commanders were elected.

This study reads the election of these ten legion commanders as the ordering of rebellion, the formation of a temporary legion OS, and the connection from correction outside institutions to institutional redesign.

2. Abstract

Ten legion commanders were elected when Verginius raised the standard of revolt because the rebellion of the army and the plebeians had to be reorganized as a temporary legion OS against the Decemvirate, instead of becoming a riot, revenge, or disorderly exit.

After the Verginia incident, the army and the plebeians stopped obeying the Decemvirate.

However, stopping obedience was not enough.

If an existing governing OS is only rejected, the army can become disorderly.

The anger of the crowd can move toward revenge.

Demands can become scattered.

No one knows who represents the movement.

Negotiation with the Senate and the plebeian side becomes difficult.

Response to external enemies can also become impossible.

Therefore, the army needed to create internal circuits of command, representation, negotiation, and order maintenance.

The election of ten legion commanders was this design.

The conclusion of this study is as follows:

When Verginius raised the standard of revolt, ten legion commanders were elected in order to prevent the rebellion of the army and the plebeians from becoming disorderly violence after obedience to the Decemvirate had stopped. Against the tyrannical Decemvirate, the army formed temporary circuits of representation, command, negotiation, and order maintenance on its own side. This was a package design by the army that connected correction outside institutions not to destruction, but to institutional redesign.

3. Research Method

This study uses TLA, or Three Layer Analysis.

TLA divides historical material into three layers.

The first layer is Fact. It organizes Livy’s account of the coercive rule of the Decemvirate, the decemvirs staying in office after their term, intimidation of senatorial opposition, the decline of Trust T in the army, Appius’ private desire, the Verginia incident, Verginius’ action, the destruction of the fasces, the military secession, the election of ten legion commanders, the secession to the Sacred Mount, and the strengthening of the tribunes, appeal, and plebeian resolutions.

The second layer is Order. It extracts the structure behind the facts. It analyzes the ordering of rebellion, the counter reconstruction against the Decemvirate, the transformation of the army into a negotiable subject, the reassignment of the military execution environment, and the connection from correction outside institutions to institutional redesign.

The third layer is Insight. It derives lessons that can be applied to modern states and organizations.

This study also uses OS Organizational Design Theory R1.34.00.00.

The main concepts are as follows.

Temporary Legion OS

A temporary legion OS means a condition in which an army that has stopped obeying the existing governing OS forms temporary circuits of command, representation, negotiation, and order maintenance in order to avoid disorder.

Correction Outside Institutions

Correction outside institutions means action taken by the execution environment from outside the institution when institutional remedy has been lost.

Representative API

A representative API is a channel that connects the demands and will of a group to the outside in a negotiable form.

Command API

A command API is a command circuit that prevents the group from becoming disorderly and keeps its action aligned with a purpose.

Package Design

Package design means designing a semi autonomous execution unit with purpose, authority, execution environment, command, representation, range of action, and exit conditions.

4. Layer 1: Fact

In Livy’s Book 3, the conditions that led to the election of ten legion commanders appear step by step.

In Section 38, the decemvirs stayed in office after their term had ended.

The legitimacy of the existing governing OS declined.

In Sections 39 to 41, opposition inside the Senate and Appius’ intimidation are described.

Monitoring and correction circuits were suppressed, and institutional correction became difficult.

In Section 42, the army under decemviral command lost its will to fight.

This was an early signal of the decline of Trust T in the army.

In Section 43, an opponent was removed on the battlefield.

IA, H, NIC, and MD inside the army declined.

In Section 44, Appius used a legal claim that Verginia was a slave in order to obtain her.

Private desire was connected with judicial form.

In Section 45, Icilius protested against the unjust judgment, and citizen anger increased.

Corrective information from citizens appeared.

In Section 46, Appius delayed execution but did not change his intention.

Corrective information arrived, but judgment was not corrected.

In Section 47, Verginius appealed for his daughter’s freedom.

A private incident expanded into a question of free status.

In Section 48, Verginius killed his daughter.

The rebellion against the Decemvirate became decisive.

In Section 49, the crowd destroyed the fasces.

This was the withdrawal of approval from public office authority.

In Section 50, Verginius appealed to the soldiers.

A private incident was transformed into military secession.

In Sections 51 and 52, the army and the plebeians seceded to the Sacred Mount.

The execution environment stopped participating in the governing OS.

In this process, the army elected ten legion commanders.

This shows that the army, after secession, did not become disorderly. It formed a temporary command circuit inside itself.

In Section 53, the plebeians demanded the tribunes, the right of appeal, and immunity for those who had seceded.

The rebellion was transformed into a demand for the restoration of correction circuits.

In Section 54, the decemvirs resigned, the tribunes were elected, and those who had seceded were not punished.

The tyrannical OS was stopped, and representative institutions were restored.

In Section 55, appeal, the inviolability of the tribunes, and plebeian resolutions were strengthened.

The freedom protection circuit was redesigned.

In Section 59, Duilius stopped further revenge.

This prevented the rebellion from becoming a revenge OS and connected it to institutional recovery.

5. Layer 2: Order

The structure of this case is to read the election of ten legion commanders as an intermediate design that prevented rebellion from becoming a riot.

To prevent rebellion from becoming disorder

The first reason is to prevent rebellion from becoming disorder.

After the Verginia incident, the crowd became angry and destroyed the fasces.

The army stopped obeying the Decemvirate.

The plebeians seceded to the Sacred Mount.

This was a dangerous condition.

When the execution environment leaves the governing OS, the following risks appear:

The army may lose control.

The crowd may move toward revenge.

Individual anger may become violence.

Demands may become scattered.

No one may know who represents the movement.

Negotiation with the Senate and the patricians may become impossible.

Response to external enemies may also become impossible.

Therefore, the army needed not only to secede, but also to build internal order.

The ten legion commanders were a temporary circuit for that order.

From the perspective of OS Organizational Design Theory, this structure can be expressed as follows:

Ordering of Rebellion
= Stop of Obedience to the Existing OS
× Temporary Command API
× Representative API
× Demand Aggregation
× Internal Control
× Negotiability
× Possibility of Reconnection to Institutions

If this structure exists, rebellion does not become disorder.

It becomes pressure for institutional redesign.

A counter ten person structure against the Decemvirate

The second reason is symbolic opposition to the Decemvirate.

The Decemvirate had originally been a reform institution to write the law.

However, under the second Decemvirate, there was no appeal, no tribunes, concentrated authority, loss of term control, and pseudo kingship.

The “ten men” of the Decemvirate no longer symbolized legal reform.

They symbolized tyranny without appeal.

In contrast, the army’s election of ten commanders can be read as an act that recovered the same form of “ten” for representation and order, not for tyranny.

This was not merely an accidental number. It can be read as the following counter structure.

DecemvirateTen Legion Commanders
Concentration of authority from aboveElection from below
No appealRepresentation of the rebel side
Suppression of monitoringAggregation of demands
Private desire and power preservationDemand for recovery of freedom protection circuits
Pseudo kingshipTemporary legion OS
Destruction of Trust T in the execution environmentReorganization of Trust T in the execution environment

Therefore, the ten legion commanders were a counter reconstruction against the collapsed Decemvirate.

However, Livy does not explicitly say that the same number “ten” was chosen as a symbolic opposition.

Here, this is a structural reading based on TLA and OS Organizational Design Theory.

To make the army a negotiable subject, not a crowd of soldiers

The third reason is to make the army a negotiable subject.

If the army moved only by anger, it would be an uncontrollable violent group from the viewpoint of the governing OS.

However, if commanders are elected, the army can do the following:

It can aggregate opinions.

It can organize demands.

It can maintain formation.

It can control action.

It can have a negotiation partner.

It can connect to the Senate and the plebeian side.

It can organize the secession to the Sacred Mount.

This is close to a representative interface and package design in OS Organizational Design Theory.

The army seceded from the governing OS, but it did not become complete disorder.

Rather, by electing ten commanders, the army reorganized itself as a semi autonomous package.

Package Design of the Army Side
= Purpose
× Command API
× Representative API
× Internal Control
× Range of Action
× Negotiability
× Exit Conditions

The exit conditions were institutional redesign, such as restoration of the tribunes, restoration of appeal, immunity for seceders, and the end of the Decemvirate.

To cut the military execution environment off from the tyrannical OS

The fourth reason is to cut the military execution environment off from the tyrannical Decemvirate.

The army is the execution environment of the state OS.

However, if the Decemvirate becomes tyrannical and does not protect citizen freedom, continued obedience by the army means that the army works as the execution environment of a tyrannical OS.

The army faced the following question:

Are we fighting for Rome?

Or are we fighting for the Decemvirate that destroys freedom?

In Section 42, the army under decemviral command lost its will to fight.

This was not a lack of ability.

It was a decline of Trust T and willingness to cooperate with the governing OS.

In Sections 50 to 52, the army and the plebeians resisted and seceded to the Sacred Mount.

This was the moment when the military execution environment refused to participate in the tyrannical OS.

The election of ten legion commanders shows that the army refused to remain the execution environment of the Decemvirate and reconnected its military order to another circuit.

This was the reassignment of the execution environment by the army.

To connect correction outside institutions to institutional redesign

The fifth reason is to connect correction outside institutions to institutional redesign.

The secession of the army and the plebeians to the Sacred Mount was correction outside institutions.

However, correction outside institutions is dangerous.

It can move toward revenge.

It can become disorder.

It can become civil war.

It can make response to external enemies impossible.

Therefore, correction outside institutions had to be connected to institutional redesign.

The ten legion commanders were a connection circuit for that purpose.

Because the army had representation and command, its demands could return to institutions.

Restoration of the tribunes.

Restoration of appeal.

Immunity for seceders.

Resignation of the decemvirs.

Election of the tribunes.

Strengthening of plebeian resolutions.

The process could move toward these outcomes.

Therefore, the ten legion commanders were a temporary design that prevented correction outside institutions from becoming destructive output.

6. Layer 3: Insight

The core of this case is to read the election of ten legion commanders as the formation of internal order on the rebel side.

Model of temporary legion OS

The election of ten legion commanders can be expressed as the formation of a temporary legion OS.

Temporary Legion OS
= Stop of Obedience to the Decemvirate
× Reorganization of Trust T inside the Army
× Election of Ten Commanders
× Formation of Representative API
× Formation of Command API
× Formation of Negotiation API
× Ordering of the Secession to the Sacred Mount

The important point is that the army did not simply secede.

After secession, it reorganized itself.

Without this reorganization, the army could have become a mob.

But by establishing ten commanders, the army became a subject of institutional redesign.

Model of ordering rebellion

The ordering of rebellion can be expressed as follows:

Ordering of Rebellion
= Collapse of Trust T in the Execution Environment
× Visualization of the Collapse of Legitimacy
× Anger of the Crowd
× Military Secession
× Election of Representatives
× Internal Control
× Demand Aggregation
× Negotiability

When this structure exists, rebellion does not become only an explosion.

It becomes pressure for institutional redesign.

Model of counter OS formation

The ten commanders were a counter OS against the Decemvirate.

Counter OS Formation
= Withdrawal of Approval from the Tyrannical OS
× Election of the Same Number of Representatives
× Clarification of the Army Side’s V
× Demand for Recovery of the Freedom Protection Circuit
× Renegotiation with the Governing OS

The ten men of the Decemvirate symbolized tyranny from above.

The ten commanders of the army symbolized representation from below.

This is the political meaning of the numerical correspondence.

However, this is a structural interpretation, not an explicit intention stated by Livy.

Model of reassignment of the execution environment

The army is the execution environment that operates the military application of the state OS.

However, when the state OS becomes tyrannical, the army must judge where it should execute its power.

Reassignment of the Execution Environment
= Decline of Trust T in the Tyrannical OS
× Visualization of the Violation of Citizen Freedom
× Stop of Obedience to the Existing Command System
× Formation of a Temporary Command System
× Connection to the Demand for Recovery of Freedom

Through this structure, the army ceased to be the military execution environment of the Decemvirate and became the execution environment of the demand for the recovery of freedom.

Model of reconnection from correction outside institutions to institutions

The movement from correction outside institutions to institutional reconnection can be expressed as follows:

Institutional Reconnection
= Secession to the Sacred Mount
× Formation of Army Side Representation
× Aggregation of Plebeian Demands
× Negotiability with the Senate
× Resignation of the Decemvirs
× Restoration of the Tribunes
× Restoration of Appeal
× Strengthening of Plebeian Resolutions
× Recovery of Trust T

The ten commanders were the early circuit of this institutional reconnection.

Without them, the secession to the Sacred Mount could have become an unclear exit without organized demands.

With representation and command, the secession was connected to institutional redesign.

Operating model

The process by which the election of ten legion commanders worked can be organized in five stages.

The first stage is the stop of obedience to the tyrannical OS.

Stop of Obedience to the Tyrannical OS
= No Appeal
× Absence of Tribunes
× Privatization of Justice
× Verginia Incident
× Destruction of the Fasces
× Military Secession

At this point, the army and the plebeians no longer recognized the Decemvirate as a legitimate governing OS.

The second stage is the appearance of the risk of disorder.

Risk of Disorder
= Loss of Command System
× Anger of the Crowd
× Desire for Revenge
× Scattered Demands
× Inability to Respond to External Enemies
× Inability to Negotiate

To prevent this risk, a temporary command system was necessary.

The third stage is the election of ten commanders.

Election of Ten Commanders
= Internal Order of the Army
× Representative API
× Command API
× Demand Aggregation
× Counter Form against the Decemvirate
× Negotiability

At this point, the army became not merely a seceding group, but a temporary legion OS.

The fourth stage is the organization of the secession to the Sacred Mount.

Organization of the Secession to the Sacred Mount
= Command of the Army
× Joining of the Plebeians
× Pressure on the Decemvirate
× Restraint of Riotization
× Demand for Institutional Redesign

The secession was not simple flight.

It was a stop of participation in the governing OS and a demand for redesign.

The fifth stage is connection to institutional redesign.

Connection to Institutional Redesign
= Demand for the Tribunes
× Demand for Appeal
× Immunity for Seceders
× Resignation of the Decemvirs
× Election of the Tribunes
× Strengthening of Appeal
× Strengthening of Plebeian Resolutions

At this point, rebellion moved not toward destruction, but toward reconnection of the republican OS.

Causal Chain

The causal chain of this case can be organized as follows:

Coercive Rule of the Decemvirate
→ Staying in Office after the Term
→ Intimidation of Senatorial Opposition
→ Closure of IA
→ Decline of Trust T in the Army
→ Removal of Opponents
→ Decline of H inside the Army
→ Appius’ Private Desire
→ Use of the Slave Status Claim
→ Verginia Incident
→ Extreme Action by Verginius
→ The Crowd Destroys the Fasces
→ Withdrawal of Approval from Public Office Authority
→ Verginius Appeals to the Soldiers
→ The Army Stops Obeying the Decemvirate
→ Loss of Command System and Risk of Disorder Appear
→ Ten Legion Commanders Are Elected
→ Temporary Command API and Representative API Are Formed on the Army Side
→ Secession to the Sacred Mount Is Organized
→ Plebeian Demands Are Aggregated
→ Demand for the Tribunes Appeal and Immunity for Seceders
→ Resignation of the Decemvirs
→ Election of the Tribunes
→ Strengthening of Appeal Inviolability of the Tribunes and Plebeian Resolutions
→ Correction Outside Institutions Is Connected to Institutional Redesign

This causal chain shows that the election of the ten legion commanders was an intermediate design that prevented the rebellion from becoming a riot.

The existing Decemvirate OS had lost legitimacy.

However, if the existing OS is only rejected, the army can become disorderly.

Therefore, the army created a temporary ten person structure on its own side and connected the stop of obedience to the tyrannical OS with institutional redesign.

Final Insight

The final insight is as follows:

When Verginius raised the standard of revolt, ten legion commanders were elected in order to prevent the rebellion of the army and the plebeians from becoming disorderly violence after obedience to the Decemvirate had stopped. The Verginia incident destroyed the legitimacy of the Decemvirate, and the army and the plebeians stopped participating in the governing OS. However, if the execution environment that had seceded did not have representation and command, the rebellion could have moved toward revenge, violence, scattered demands, and inability to negotiate. Therefore, the army elected ten commanders and formed temporary circuits of command, representation, negotiation, and order maintenance inside itself. This ten person structure was a counter reconstruction against the tyrannical Decemvirate and a temporary legion OS that connected correction outside institutions to institutional redesign.

7. Implications for the Modern World

This analysis can be applied to modern companies, public institutions, schools, and nonprofit organizations.

When injustice or unfair treatment occurs inside an organization and institutional remedy does not work, the workplace may secede in many forms.

People may resign.

People may become whistleblowers.

People may organize collective protest.

People may file lawsuits.

People may post accusations on social media.

Information may leak outside the organization.

However, if this secession spreads in a disorderly way, it becomes only public outrage or destruction.

On the other hand, if the seceding side has representatives, organizes demands, creates a negotiation channel, and sets exit conditions, the movement can connect to organizational redesign.

Modern organizations need the following designs.

1. Representatives on the seceding side

If dissatisfaction is scattered, the organization cannot negotiate.

If there are representatives, demands can be aggregated.

2. Organized demands

Anger alone cannot lead to redesign.

The movement must clarify what should be restored.

Appeal.

Consultation.

Third party confirmation.

Prevention of retaliation.

Accountability.

Redesign of evaluation systems.

These must be made concrete.

3. Negotiation channels

To connect correction outside institutions to redesign, negotiability is necessary.

Without negotiation channels, conflict becomes long term.

4. Exit conditions

What must be achieved for the exit or protest to end?

Without exit conditions, correction outside institutions can easily become revenge or public outrage.

5. Prevention of riotization and public outrage

Correction outside institutions contains anger.

However, if that anger becomes disorderly, it becomes destruction, not reform.

Representation, command, and demand aggregation are necessary.

The lesson for modern organizations is as follows:

Whether correction outside institutions becomes disorder or connects to institutional redesign depends on whether the seceding side can have representation, command, demand aggregation, and negotiability. When the workplace loses institutional remedy, what is needed is not only anger, but a temporary representative circuit and clear redesign demands.

8. Conclusion

This case is important for understanding the rebellion after the Verginia incident not as a mere explosion of anger, but as a process that transformed correction outside institutions into institutional redesign.

Verginius’ action destroyed the legitimacy of the Decemvirate.

The crowd destroyed the fasces.

The army seceded.

The plebeians moved to the Sacred Mount.

At first glance, Rome seemed to move toward disorder.

But in fact, this was not simply disorder.

The army elected ten commanders.

This shows that the rebel side reorganized itself as an ordered subject.

Without this election, the army might have become only an angry group.

However, with ten legion commanders, the army could aggregate demands.

It could control action.

It could organize the secession to the Sacred Mount.

It could connect to the Senate and the plebeian side.

It could move toward institutional redesign.

The number “ten” also has a counter meaning against the Decemvirate.

The Decemvirate had become tyrannical through concentration of authority from above.

The ten legion commanders organized rebellion through election from below.

The same number had the opposite meaning.

The Decemvirate was a tyrannical OS without appeal.

The ten commanders of the army were a temporary legion OS connected to institutional redesign.

This point is important for understanding the self repair capacity of the Roman republican OS.

However, this reading of a “counter ten person structure” is not an explicit statement in Livy.

It is a structural interpretation based on TLA and OS Organizational Design Theory.

The key point is that the army had representation and command after secession and avoided disorder.

Rome moved into correction outside institutions after institutional remedy had been lost.

However, it did not let this correction end as destruction.

Through representation, command, negotiation, and demand aggregation, Rome moved toward institutional reconnection.

As a result, the tribunes, the right of appeal, immunity for seceders, and plebeian resolutions were strengthened.

The conclusion of this study is as follows:

Whether correction outside institutions becomes disorder or connects to institutional redesign depends on whether the rebel side can have representation, command, demand aggregation, and negotiability. Ten legion commanders were elected after Verginius raised the standard of revolt in order to order the stop of obedience to the Decemvirate as a temporary legion OS, not as a riot, and to connect it to the redesign of the tribunes, appeal, and plebeian resolutions.
